Administration of the permanent residence permit

A national permanent residence permit is granted to a third-country national, but is not exhaustive,who have a secure place of residence and livelihood in Hungary,

W

who is insured for the full range of health care benefits or who can meet the costs of their health care,

W

who is not ineligible,

W

who holds a residence permit or a temporary residence permit,

W

whose settlement is in the interests of Hungary and:

W

have resided legally and uninterruptedly in Hungary for at least three years immediately prior to the submission of the application;

W

has been living as a dependent ascendant in a family relationship with a Hungarian citizen or an immigrant, settled or recognised third-country national as a refugee for at least one year immediately prior to the submission of the application;

W

the spouse of a Hungarian citizen or a third-country national who has immigrated, settled or been recognised as a refugee, provided that the marriage was contracted at least two years before the application was submitted;

W

was a Hungarian citizen but has lost his/her citizenship, or whose ancestor is or was a Hungarian citizen
a minor child of an immigrant, settled or recognised third-country national who is a refugee.

HOW TO APPLY AND INFORMATION ON THE PROCEDURE
Prerequisites: submission of the completed form, a photo not older than three months, the required annexes, and the procedure fee.

The Law Firm can submit the application and the annexes to the competent authority by proxy. However, the concerned person must appear in person at the authority when making the application.

     

    Administration of residence permit

    For a third-country national wishing to reside in Hungary, we can define several types of residence permits, without claiming to be exhaustive:

    Residence permit for employment purposes
    A residence permit for employment purposes may be issued to a third-country national whose purpose of residence is as follows:

    • actually performs work (on the basis of an employment relationship, for remuneration, for or under the direction of another person);
    • actually carrying out work (as owner or manager of a legal person established for gainful purposes)

    The application must include, inter alia

    • a form
    • a photo of the person’s face taken not more than 3 months previously
    • compulsory annexes
    • a procedural fee

    Residence permit for other purposes:

    In principle, a residence permit for other purposes can be applied for by a person from a third country who does not wish to reside in Hungary for a reason specified in the Act. This is the case if the purpose of the stay in Hungary is to learn a language.

      Administration related to the acquisition of citizenship

      Acquiring Hungarian citizenship entitles the person who acquires it to exercise the rights and to fulfil the obligations of Hungarian citizenship. Acquisition of citizenship by naturalisation is by application only.

      The conditions for naturalisation are based primarily on the relationship between the state and the prospective citizen.

      In general, the conditions are as follows:

      • residence and livelihood in Hungary
      • no criminal record
      • public security and national security are not endangered by naturalisation
      • pass a basic constitutional knowledge exam in Hungarian
      • foreign status living in Hungary

      The duration of residence is subject to different conditions. If the applicant does not qualify for a benefit, 8 years of residence in Hungary are required for the naturalisation application

        Aid for the acquisition of real estate by foreigners

        If a foreigner acquires real estate, permission from the Government Office where the property is located is required. The rules apply to both residential and agricultural and other types of property.

        A permit is NOT required in the following cases, but this is not exhaustive:

        • the person acquiring the property is a national of an EU Member State or a legal person registered in an EU Member State;
        • a national of an EEA Member State or a legal person registered in an EEA Member State;
        • a Swiss national is the acquirer of the real estate;
        • the acquirer of the real estate acquires ownership of the real estate by inheritance

        The authorisation requires, inter alia:

        • submission of the relevant application;
        • payment of the fee;
        • payment of the fee; – a valid travel document/identity document/authentic company certificate
        • Contract for the acquisition of the property
